Regulatory legal acts of the Republic of Belarus regulating the sphere of wind energy

A lot of attention is paid to the development of wind energy and all renewable energy sources in the Republic of Belarus.

A number of regulatory legal acts in the sphere of renewable energy are in force, including:

●        Law of the Republic of Belarus of 27.12.2010 №204- Z “On renewable energy sources”;

●        Edict of the President of the Republic of Belarus of 18.05.2015 №209 “On the use of renewable energy sources”;

●        Directive of the President of the Republic of Belarus of 14.06.2007 №3 “Economy and thrift – the main factors of economic security of the state”;

●        Resolution of the Council of Ministers of the Republic of Belarus of 09.08.2010 №1180 “On approval of the development strategy of the energy potential of the Republic of Belarus”;

●        Resolution of the Council of Ministers of the Republic of Belarus of 24.06.2011 №836 “ On approval of the Regulation on the State Cadastre of renewable energy sources and the use of its data, the Regulation on the procedure of confirmation of the origin of energy produced from renewable energy sources, and the issuing of a certificate to confirm the origin of energy and amendments to some resolutions of the Council of Ministers of the Republic of Belarus”;

●        Resolution of the Council of Ministers of the Republic of Belarus of 06.08.2015 №662 “On the establishment and distribution of quotas for the creation of facilities for the use of renewable energy sources”;

●        Resolution of the Council of Ministers of the Republic of Belarus of 07.08.2015 №45 “On the tariffs for electricity produced from renewable energy sources on the territory of the Republic of Belarus by individual entrepreneurs and legal entities who are not members of the State Electricity Production Association “Belenergo”, and released to supply companies of this association”;

●        Resolution of the Council of Ministers of the Republic of Belarus of 30.12.2008 №2044 “On approval of the conclusion to classify the imported goods as installations using renewable energy”;

●       Tax Code (in accordance with Article 96, installations using renewable energy are exempt from value added tax for the goods imported into the territory of the Republic of Belarus).


In Belarus, there are also technical regulatory legal acts that establish specific requirements regarding the placement of wind turbines, carrying out measurements of wind potential:

●        TCP 17.02-02-2010 (02120) “Environmental protection and natural management. Terms of placement and design of wind turbines”;

●        TCP 17.10-39-2012 (02120) “Environmental protection and natural management. Procedure for assessment of wind power potential in the deployment of wind power turbines on the territory of the Republic of Belarus”;

●        TCP 17.10-33-2011 (02120) “Environmental protection and natural management. Охрана окружающей среды и природопользование. Hydrometeorological activity. The procedure for measuring the wind parameters and use of the obtained data for planning the placement of wind turbines”.
